Two different roles — and which one applies to you
Data protection law distinguishes the organisation that decides why data is used (the controller) from one that handles it on that organisation’s instructions (the processor). We are sometimes one and sometimes the other, and it changes who is answerable to you.
| Your data | Who controls it | Our role |
|---|---|---|
| You are a landlord or agent with an account — your account and billing details, and how you use the platform | MarketStack Limited | Controller |
| You enquired about a property or contacted us through this website | MarketStack Limited, and the landlord you enquired to | Controller |
| You are a tenant or applicant — your tenancy, referencing, Right to Rent and payment records | Your landlord, not us | Processor, acting on their instructions |
Where we act as a processor we only use the data to provide the service to your landlord — we do not decide what happens to it, and we do not use it for our own purposes. If you are a tenant and want your data corrected or erased, your landlord is the right first point of contact; we will help them action it. Landlords currently using the platform: Bear Guru Property Partners Limited (12380520).
Whose data we handle
Tenants and prospective tenants, landlords and property owners, applicants and enquirers, guarantors, and third parties such as contractors and referees.
What data we collect
- Identity and contact — name, address, email, phone.
- Application and tenancy — employment and income, references, current landlord, tenancy details, rent records.
- Identity documents — passport, driving licence or BRP, for Right to Rent checks.
- Financial — bank and payment details, transaction records.
- Property and account — for landlords, property, management and financial-statement details.
- Marketing — your contact details and preferences where you have opted in, or where we contact landlords about our services.
Why we use it, and our lawful basis
| What we do | Lawful basis |
|---|---|
| Handle enquiries, viewings and applications | Steps at your request before a contract; our legitimate interests |
| Referencing and credit checks | Contract and pre-contract steps |
| Right to Rent identity checks | Legal obligation |
| Manage your tenancy or landlord account | Performance of our contract with you |
| Protect deposits in a statutory scheme | Legal obligation |
| Payments, accounting and record keeping | Contract; legal obligation (tax and accounting) |
| Email alerts you opted into | Your consent |
| Contacting landlords about our services | Our legitimate interests, with an easy opt-out |
Where we act as a processor— tenancy, referencing, Right to Rent and rent records — the lawful basis above is your landlord’s, and we rely on their instructions rather than choosing a basis ourselves.
Who we share it with
We share data only as needed with referencing agencies, payment processors and our accountant, a statutory deposit protection scheme, contractors carrying out maintenance, and regulators, HMRC or law enforcement where legally required.
We also use the following service providers to run the platform:
| Provider | What they do for us |
|---|---|
| Supabase | Database, authentication and document storage |
| Vercel | Website hosting, plus anonymous traffic analytics |
| Cloudinary | Hosting property and room photographs |
| Stripe | Card payments for optional services |
| Twilio | SMS and WhatsApp messages about rent and tenancies |
| Google (Workspace) | Sending and logging email correspondence |
| Anthropic | Drafting property listing text |
| Xero / Intuit QuickBooks | Accounting and invoicing records |
Each provider is bound by a contract requiring them to protect your data. We do not sell your personal data.
International transfers
Some of the providers listed above store or process data outside the UK. Where they do, we rely on an appropriate safeguard — UK adequacy regulations, or standard contractual clauses with the UK International Data Transfer Addendum.
How long we keep it
Only as long as necessary. In summary: unsuccessful applicants, a short period; tenancy and landlord records, for the length of the relationship plus a legal tail; financial records, around six years; Right to Rent copies, for as long as the Home Office scheme requires.
Your rights
You have the right to access your data, correct it, erase it, restrict or object to processing, request portability, and withdraw consent or opt out of marketing at any time. To exercise any right, contact benjamin.hicks@beaulah.ch. We respond within one month. If you are a tenant or applicant, your landlord is the controller of that data, so ask them first — but write to us if you are unsure who that is, or if you get no response, and we will make sure your request reaches them.
You can also complain to the Information Commissioner’s Office at ico.org.uk, though we would ask you to raise it with us first.
