What personal data we collect, why we collect it, who we share it with, and the rights you have over it.

Who we are

MarketStack Limited(“we”, “us”) operates the RentStack platform.

Two different roles — and which one applies to you

Data protection law distinguishes the organisation that decides why data is used (the controller) from one that handles it on that organisation’s instructions (the processor). We are sometimes one and sometimes the other, and it changes who is answerable to you.

Where we act as a processor we only use the data to provide the service to your landlord — we do not decide what happens to it, and we do not use it for our own purposes. If you are a tenant and want your data corrected or erased, your landlord is the right first point of contact; we will help them action it. Landlords currently using the platform: Bear Guru Property Partners Limited (12380520).

Where we act as a processor— tenancy, referencing, Right to Rent and rent records — the lawful basis above is your landlord’s, and we rely on their instructions rather than choosing a basis ourselves.

Who we share it with

We share data only as needed with referencing agencies, payment processors and our accountant, a statutory deposit protection scheme, contractors carrying out maintenance, and regulators, HMRC or law enforcement where legally required.

Each provider is bound by a contract requiring them to protect your data. We do not sell your personal data.

International transfers

Some of the providers listed above store or process data outside the UK. Where they do, we rely on an appropriate safeguard — UK adequacy regulations, or standard contractual clauses with the UK International Data Transfer Addendum.

How long we keep it

Only as long as necessary. In summary: unsuccessful applicants, a short period; tenancy and landlord records, for the length of the relationship plus a legal tail; financial records, around six years; Right to Rent copies, for as long as the Home Office scheme requires.

Your rights

You have the right to access your data, correct it, erase it, restrict or object to processing, request portability, and withdraw consent or opt out of marketing at any time. To exercise any right, contact benjamin.hicks@beaulah.ch. We respond within one month. If you are a tenant or applicant, your landlord is the controller of that data, so ask them first — but write to us if you are unsure who that is, or if you get no response, and we will make sure your request reaches them.

You can also complain to the Information Commissioner’s Office at ico.org.uk, though we would ask you to raise it with us first.

We may update this notice. The current version is always the one published on this page.
